These Terms of Use ("Terms") govern your use of thegreenhousecannabisco.com, including our online menu (together, the "Site"), operated by Lakeview Leaf LLC, doing business as The Greenhouse Cannabis Co ("The Greenhouse," "we," "us," or "our"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

You must be 21 or older

The Site is intended only for adults 21 years of age or older. By using the Site, you confirm that you are at least 21. A valid, unexpired government-issued photo ID is required to enter our store and to pick up any order. We may refuse service to anyone who cannot verify their age.

Cannabis is regulated in Minnesota

The Greenhouse sells cannabis products in compliance with Minnesota law and the rules of the Minnesota Office of Cannabis Management. You are responsible for following all laws that apply to you, including purchase and possession limits, rules about where cannabis may be used, and the prohibition on driving or operating machinery while impaired. Cannabis products may not be taken across state lines.

Online orders and pickup

• Orders placed through our online menu are reservations for in-store pickup. Payment is collected in store at pickup.
• Placing an order does not guarantee availability. We may cancel or adjust an order if a product is out of stock, a price is listed in error, or the order would exceed a legal limit.
• Orders must be picked up by the person who placed them, who must present valid ID matching the order. Unclaimed orders may be canceled and returned to inventory.
• We are not able to offer delivery unless we state otherwise on the Site.

Product information and pricing

We work to keep our menu, prices, potency information, and availability accurate and current, but errors can happen and inventory changes throughout the day. Product images are for illustration and may differ from actual products. Prices shown online do not include applicable taxes. Prices, promotions, and availability are subject to change without notice. Promotions cannot be combined unless stated and are subject to legal limits.

No medical advice

Information on the Site is for general educational purposes only and is not medical advice. Our products are not intended to diagnose, treat, cure, or prevent any disease, and statements about them have not been evaluated by the U.S. Food and Drug Administration. Effects vary from person to person. Talk with a healthcare provider before using cannabis, especially if you are pregnant, breastfeeding, or taking medication. Keep cannabis products out of reach of children and pets.

Using the Site

You agree not to:

• Use the Site if you are under 21 or on behalf of anyone under 21.
• Use the Site for any unlawful purpose or to buy products for resale or for anyone who may not legally purchase them.
• Provide false information, including false age or identity information.
• Interfere with the Site's security or operation, or attempt to access accounts, systems, or data without authorization.
• Scrape, copy, or collect content or data from the Site by automated means without our written permission.

If you create an account, you are responsible for keeping your login secure and for activity under your account.

Our content

The Site and its content, including text, graphics, logos, photos, and design, are owned by or licensed to The Greenhouse and are protected by intellectual property laws. You may view and print content for your personal, noncommercial use. You may not otherwise copy, modify, distribute, or use our content or trademarks without our written permission.

Third-party services and links

Our online menu is provided by our e-commerce partner, Sweed, and the Site may link to other third-party sites and services. We are not responsible for third-party sites or services, and your use of them may be subject to their own terms and policies.

Messages from us

If you sign up for our emails or text messages, you agree to receive marketing messages from us at the contact information you provide. You can unsubscribe from emails using the link in any message, and you can opt out of texts by replying STOP. Message and data rates may apply. Consent is not a condition of purchase.

Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, secure, or error-free.

Limitation of liability

To the fullest extent permitted by law, The Greenhouse and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site. Our total liability for any claim related to the Site will not exceed one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless The Greenhouse and its owners, employees, and partners from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your misuse of the Site or violation of these Terms or the law.

Governing law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Minnesota, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated version here and change the effective date above. Your continued use of the Site after changes are posted means you accept the updated Terms.

General

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site.
